Welcome to our martial arts class! We’re excited to have you join us on this journey of self-discovery and growth. By attending our classes, you are accepting, agreeing, and fully consenting to the Terms & Conditions at all times.

1. ELIGIBILITY & CONDUCT: (a) You must complete and sign our registration form in abidance with our Terms & Conditions, acknowledging the physical demands and inherent risks associated with martial arts training. (b) You confirm that you are 18 years of age or older, not classified as a vulnerable person, and competent to act and behave responsibly. (c) We reserve the right to refuse entry to anyone or remove anyone from our class who is considered not suitable for the class for any reason, as determined by the teacher. (d) It is your responsibility to ensure that you have your own appropriate insurance coverage. (e) You should consult with your medical doctor before joining the training. (f) Our core aim is to foster a friendly and compassionate atmosphere for all. We require students to treat everyone with kindness and display respectful behaviour at all times. Any non-compliance as determined by the teacher could result in you being expelled from the class.

 

2. ASSUMPTION OF RISK: (a) Our traditional martial arts primarily involve partner-based training, involving punching, kicking, joint locking, throws, dummy weapons, and more. Such training is designed to prepare you for a wide range of real-life challenges and dangers. In certain instances, the training may push your resilience, requiring you to experience a degree of discomfort, pain, physical impacts, strains, or other challenges to condition your fortitude and prepare you to protect yourself in real-life situations. By participating in our martial arts classes, you fully understand and agree that martial arts training is a physical activity that inevitably carries inherent risks and most likely your health will be affected. These risks may include, but are not limited to minor or serious injuries, disabilities, or any other health consequence, or even fatality. (b) The Bujinkan curriculum includes a core set of techniques and practices, while also encouraging individual teachers to integrate their own ideas, exercises, and insights. You are expected to embrace the dynamic nature of such training, understanding that teachers may introduce their unique perspectives and practices, intending to broaden the understanding and application of our martial arts principles. The teacher may also integrate principles of traditional Japanese Medicine inherited by the Bujinkan, known as 'Amatsu', to enhance your understanding of the martial art through holistic medicine. This integration offers insights on medicine, science, philosophy, spirituality, and various other topics, which may include the teacher's personal viewpoints.

 

3. HEALTH & SAFETY: (a) It is your responsibility to inform the teacher of any pre-existing or new injuries or medical conditions that may affect your training so that the teacher where possible can make adjustments, modify, or adapt the training program, exercises or techniques. However, you must remember at all times, that you are participating in the class entirely at your own risk. (i) You acknowledge that the instructor is committed to helping all students, but due to multi-tasking challenges, constant supervision for each person may not be possible. Therefore, they may not always be available to assist you. As a responsible adult, it's crucial to exercise good judgment and act independently for your safety and the safety of others, especially when the teacher is unable to supervise you. (j) As an adult participant, it is your responsibility to make informed judgments about your training and take appropriate measures to safeguard your health. Therefore, you acknowledge and agree to assume full responsibility for your own health and well-being, holding the teacher, the other students, and the premises free from any liability.

 

4. LIABILITIES: (a) You acknowledge that our training aims to promote peace and discourage unnecessary fighting. You agree that self-defence should only be used as a last resort. (b) You understand that any information or instruction provided by the teacher regarding martial arts, fighting, survival, health, well-being, philosophy, spirituality, lifestyle, and any other topic covered in the class is general advice, not personalised advice. The teacher shall not be held liable for any incidents resulting from the application of such information to your life. (d) By joining our class, you acknowledge and accept full responsibility for any consequences that may arise from your participation. You hereby release the teacher, the other students, or any other parties involved and the premises from any liability or any claim arising from such risks. This release applies regardless of whether you actively participate, view, listen, or receive inputs from our training in any other way. (e) You agree to use dummy tools such as plastic or wooden training swords, padded sticks, and other training-related equipment as substitutes for real weapons. You agree to use these tools responsibly and release the teacher, other students, and the premises from any liability arising from their use. (f) You are financially responsible for any damage caused by you to the premises during training, whether alone or with a partner or a group. If the damage was caused by you, promptly reimburse the affected party. In the case of damage caused with a partner or a group, amicably resolve the matter amongst yourselves and promptly reimburse the affected party, involving all participants responsible. As an adult, you acknowledge and take responsibility for your individual actions, even if they occurred following the teacher's instructions. You agree to reimburse any costs without holding the teacher liable. The teacher is released from any liability for the costs and from involvement in the resolution between you and the other parties involved.

 

5. TERMS AND UPDATES: (a) These Terms & Conditions are governed by UK laws (England and Wales). (b) If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable. (c) These Terms & Condition are applicable retrospectively as well as from this date onwards. (d) If your personal details or circumstances change, you must inform us immediately. (e) These Terms & Condition apply at all times from the day you start your first training to all the future training you undertake. (f) We reserve the right to modify these Terms & Condition at any time and your continued participation implies acceptance of the updated terms.

The type of personal information we collect We currently collect and process the following information: First Name, Last Name, Mobile, Email, Address, Next of kin’s mobile (optional) and Signature.

All the personal information we process is provided to us directly by you for the following reasons Your information is collected when you register and sign as a student on our Registration Form, including agreement to our Terms and Conditions. This data is archived for legal reasons. We may also use the information you have given us to establish a basic form of contact for class updates, reminders, and other related information. 

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are Legitimate Interest. (a) We have a legal obligation. (b) We have a vital interest. (c) We have a legitimate interest. 

How we store your personal information Your information is securely stored. We keep the Registration Form for legal reasons and are required for a minimum of 5 years, with the possibility of an indefinite extension. However, they will be retained only for as long as is necessary. We will then dispose your information by incerenation or shredding.

Your data protection rights Under data protection law, you have rights including: Your right of access - You have the right to ask us for copies of your personal information. Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.  Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.  Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.  Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances. Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.  You are not required to pay any charge for exercising your rights.
